I am currently faced with a situation where BOA appears to have lost my permanent HAMP loan mod docs from May 2012. In the meantime I was sent a letter offering me the Principle Reduction from the DOJ Settlement, which I applied for on Oct. My saga began when husband passed away suddenly in April of 2010 and I could no longer afford to make the payments on our home, which was originally financed through Countrywide and then BOA. I quit making payments in July of that year and tried to give the house back to BOA through a Deed in Lieu--after several months of unsuccessfully trying to go this route, I decided to pursue a HAMP loan mod. I was denied multiple times how hard is it to get a personal loan due to short term payday loans direct lenders missed paperwork , etc.

I made all of the payments on time and received a letter stating that I had been approved for the permanent HAMP mod on May 7, 2012. I returned the necessary docs prior to the deadline on May 14, 2012 and followed up to ensure that everything was indeed received and in order.

I loans without a cosigner was also switched to a new Account Manager a few months ago. I received a payday loans north augusta sc letter offering me a principle reduction through the Global Settlement Program. I probably would have ignored the letter, however BOA kept calling me almost daily to remind me of the deadline for sending in the necessary documents. In fact, I sent in two completely different sets of docs since one person I spoke with said that I would need two years tax returns, bank statements, hardship letter, electric bills, etc.

During several of the calls I made to check the status of the DOJ offer I was told that I would have to make a decision on whether I wanted the HAMP mod or the DOJ offer and that if I decided to go with the DOJ offer, it would void my HAMP loan and I would be unable to apply for that again and may end up in a situation where I was once again facing foreclosure. Other people I spoke with told me that I could apply without jeopardizing the HAMP loan.

Every person I speak with seems to have a different story. I spoke with my account manager the other day and he informed me that they had no paperwork on file for my permanent mod and I would need to submit all of the necessary docs to qualify for that loan. After providing him with dates, tracking numbers, names, etc. He said he is going to escalate the matter of my lost docs up the ladder and that I should never have been sent the DOJ offer.

The reason I was is because due to the lost docs it appeared at the time that I did not have a loan mod so I would have qualified. I think at this point since they were the ones who made the mistakes and were encouraging me to apply for the DOJ offer money quick that they should honor my application. I have detailed notes from every phone call and the documents to support every dealing that I have had with BOA since July of 2010. It has been a bungled ordeal from the beginning and it is beyond incomprehensible at this point that I am still dealing with this. I have already reported the matter to the Office of Mortgage Settlement Oversight, but I would like to take it further--does anyone have any advice or personal experience with this type of issue.

I did call the executive team who said the same thing they are in the closing department but we have everything and you signed the final docs.

I guess the normal is sixty to ninety days which seems long in duration to me but I guess that is what it is. They robo signed my foreclosure docs (I got a settlement) they lost my modification docs so I am on round two.

I did get in touch with the BofA executive team and had my file escalated within a week of this post. On Friday my representative finally told me that my income had been verified by the underwriter and a decision would come, generally, within 30 days.

I have no way of seeing any statement reflecting any of them and other than the electronic check which I have to call my personal representative to deduct each month there appears to be no record of them. If they turn me down for the global settlement I think it might be time to hire an attorney. I have excellent records for everything that has happened during the past nearly three years of working to get the loan modified. Also just losing my loan mod papers and telling me I have to start over after a two year battle that I fought getting the first loan.
