Yes, when plaintiff lets the case hang with no activity for over 1 year, the court wants it off the docket. And in F-001276-12, F-001278-12, and F-001073-12, counsel came back and filed an AFFID EXCEPT CI. Are you saying this motion was filed and you did not get a copy in the mail? Though there may be some other motion they can file. I can tell you I have searched through hundreds upon hundreds of cases in ACMS and I have never seen counsel file anything after the court order to dismiss was granted. Nothing was contested in the complaint (I did not file answer with court). Has anyone ever heard of the process taking eight years to complete? But you would think a simple motion could buy them additional time (such as AFFID EXCEPT CI that you mentioned). Nothing was contested in the complaint (I did not file answer with court). Everybody wants to know how long things will take, but nobody knows.

A few years ago we put a tenant in the house, and the agreement we had with her was that she got a SUPER discounted rent (half of market value) in exchange for her doing all repairs, since we obviously werent going to pay for repairs while in foreclosure. The tenant doesnt have the money either, and said she thought when we said as is we meant small repairs, not major things like a roof (really?? I had just gotten the foreclosure notice last month and sent it back contested. Try to fix it and find a new tenant who will accept it as is? I wonder if I should have just agreed to repair it with the current tenant in place.. At this point, we do not want to be landlords constantly getting phonecalls about fixing things since the house is older and things could come up often.

But the landlord agrees to remove the appliance at his expense, but will not replace it. But the landlord agrees to remove the appliance at his expense, but will not replace it.

I also just got a new renter and went back and forth about whether to tell them about the FC or not, I decided not to tell them for now. There is a pdf file titled Rights of tenants in foreclosed homes or something similar. Basically, a change of ownership is not a reason to evict in NJ, so if there is a written lease, the new owner is supposed to honor it. They may offer cash for keys for tenants to leave, but the new owners would have to take them to court to evict. What I am now concerned about is: if I am renting the place and it is not owner occupied, do I still get the anti deficiency protections under njac?

I found this and am also desperately searching for any cases of DJ where the home was under water. Clearly the sum of the first and second mortgages would be more than the FMV by definition, thus a Short Sale or FC.

Anyone find an actual case of a DJ within 3 months of a FC? To obtain a deficiency judgment, the lender must file a separate lawsuit within three months after the foreclosure sale or, if confirmation of the sale is required, from the date of the confirmation of the sale (N.

The court will then limit the deficiency judgment amount to the difference between the debt and the fair market value as of the date of the foreclosure sale (N. The homeowner loses the right of redemption by contesting the amount of the deficiency (N. I would suggest you contact a lawyer and just ask a few of the highest priority questions you might have. Since 2007, the LoanSafe forums first time personal loans have helped millions of homeowners over the last 13 years either save their homes with a loan modification, obtain a short sale, forbearance, or walk away legally from their underwater mortgages.

Other than a half ass attempt at a settlement with the second mortgage about two years ago, I have had ZERO contact with either mortgage companies. No phone calls, no response to written letters, pretty much nothing. Several members here have used the opposite tactic and are in constant communication with their lenders.

At the time when I started this whole thing it seemed as if the different approaches all led to the same result. But I truly do appreciate the response, hope everyone stays safe in this HOPEFULLY last storm... If you have never visited the NJ court access site, you should go there and search through some foreclosure cases to see how long it takes on average. The sequence starts at 000001 for the first case filed for 2012 and goes up from there. The later the case was filed in 2012, the less chance there has been a Final Judgment. THis will give you a history of docs filed in the case. Be sure to notice at the top of the documents page if there is a down arrow next to the word Page. That sounds exactly like what someone there told me. NJ still has pending issues with the big foreclosure irregularities problem in the state. I check foreclosures filed by my lender all the time. My lender is a relatively small player, but they have filed over 200 foreclosures since November 2012. I must have been trying to access it during the maintenance periods you mentioned - coincidence I suppose. Many of them are initiated and completed within a year or so - at least the dozen or so sample cases I saw. They seem to be aggressive in collecting outstanding debt. I have to say this Forum site is a God send to all of us going through this difficult process and thank you from the bottom of my heart...

Fairly certain (not absolutely certain) that they do not come after you personally. Check your HOA docs to see what it says about their collection rights. You first time personal loans will have to continue to pay that HOA, no matter what you decide to do. However, check your association rules some prohibit rentals. I am going to ask the president of my association why no one has been sued in 17 years. It also appears that regardless what they do, the HOAs have a big problem when it comes to delinquent dues. Whatever happened, that information should be available and in that database.

Even if the case was dismissed, it should be there.
