I did ask for the 2wk extension twice (so total of 4 weeks) from the county to delay the sheriff sale which was my legal right to do. Shortly after this, I was told my someone who knows us that they were in the driveway one day after we left and someone immediately came up to them asking if they were the owners or if they knew us (to which they replied no). Wells Fargo put a note on the door of the house about a week ago asking us to call them. A few days later, we received a certified letter to the same affect. I chatted with WF online through their website and they recommended I call the Home Preservation Department. I explained that we do not want to preserve the home. They advised I should still call and discuss my options with them. Today I received a FedEx package with a stack of forms to fill out and send in to their Home Preservation Department. I was originally planning on just not having any contact with WF and letting this play out however it will. Any guidance from the community would be greatly appreciated.

I was getting tired of getting phone calls and voicemails from WF Home Preservation department, so when they called just now, I answered the phone. The woman I spoke with, Erin, asked if we wanted to go through with a Home Preservation Interview. I explained that we cannot afford to preserve our ownership of the house. She simply said she would remove us from the department. This has been an issue that has been arising for quite some time and it frankly makes no sense why Wells Fargo would require a subordination agreement from the 2nd mortgage holder to complete a loan modification. They are the only lender requiring such actions although a loan modification is simply changing the terms of your compare loan original mortgage, not closing on a new mortgage as with a refinance... We have dozens of members here who have ran into this issue and while some second mortgage servicers (such as PNC) have no problem agreeing to sign this sub form, most other servicers will refuse to do so and the modification will ultimately be dropped, leaving foreclosure inevitable... We need to ban together and send them as many complaints as possible with something like no more subordination agreements in the subject line to bring some attention to this matter.. I would not hesitate to contact your state AG and Senator as well, it absolutely makes personal loan no credit no sense why they would be the only servicer requiring such a form to complete a loan mod!!
