I was approved for HAMP with Wells Fargo last Friday, after I had met with them in person on 9-10 here in Phx and was told their approval tool was broken. I called GreenTree and she demanded that they are not signed up for the , they only modify first loans on the HAMP program. She was extremely rude and I demanded I get the packet sent to me immediately anyway. But that seems to be what we get from these mortgage servicers anyway. Please Read our Moe, do you the loan store know if a lender is participating in the first, do they have to participate in the Second Lien Program? Indy Mac insists they are not modifying any seconds.

We got our first modified, and need help with the second. I thought if they participated in the first lien HAMP program they were required to do the 2nd.

I do know this is true for cash advance loans fannie mae and freddie mac 1st HAMP loans and it is in their unsecured personal loans no credit check guidelines. If the language is in there, use it to hit your lender upside the head with it. One West (Indy) is not on the list, but I know they are participating. We got our first modified, loans poor credit but they say they are not participating in the second lien program. I need help with the second apply loan in order to afford the first!!

One West (Indy) is not on the list, but I know they are participating.

We got our first modified, but they say they are not participating in the second lien program. I need help with the second in order to afford the first!! We called Indy Mac again today and asked them to help us with our second. My husband told them we want to pay but need a payment reduction. My husband said if we are forced to file bankruptcy, the 2nd will be stripped away, and they will get nothing, is that what they want?

My husband told them if they keep refusing people, the banks will go under and need help from us again. They said they took no bail out cash, but they got FDIC money (tax payer dollars) when they were sold. How stupid they are not to help consumers who want to pay but just need help. They would rather have us declare bankruptcy and not get anything?!?! But that seems to be what we get from these mortgage servicers anyway. If you do not find your lender on cash advance loans this list, that does not mean that they are not offering loan modifications. Most all servicers can modify your payday loans in memphis home loan at their own discretion. Moe, One West is also participating, but they say not with second lien program, how is that possible?

We got firstodified, need second modified in order to afford first?!? I think that is cash advance loans where the Presidential program is failing. Important to note here is there is a difference between lender vs servicer.

For the most up to date, see here: As for the second lien program, it came along after the original HAMP servicer participation agreements and would require the servicer to sign up for it separately, see here in first few paragraphs: I just applied to OneWest for a Second Lien modification. I am also waiting to hear from Wachovia about my 1st lien modification application.

It seems to me that while OneWest is participating in the HAMP program, there is no way to confirm if a restated or amended agreement has been signed by them to participate in the Second Lien Program. If cash advance loans anyone knows how we can confirm if OneWest has signed such an agreement please post a reply. I understand that there are a lot of incentives by the Feds for a lender to modify a 2nd lien.

I just applied to OneWest for a Second Lien modification. I am also waiting to hear from Wachovia about my 1st lien installment loans austin tx modification application. It seems to me that while OneWest is participating in the HAMP program, there is no way to confirm if a restated or amended agreement has been signed by them to participate in the Second Lien Program. If loans for bad credit in nc anyone knows how we can confirm if OneWest has signed such an agreement please post a reply. I understand that there are a lot of incentives by the Feds for a lender to modify a 2nd lien. Under HAMP, the guidelines state that if the first is modified, the second is modified automatically. HOWEVER, this is only if the servicer has agreed to participate in the second lien program (2MP).

Now rest assured that the list of participating servicers for 2MP would be published on makinghomeaffordable. They are all regretting signing up for the first one (look at how many new additions to the program have come along and all the reporting requirements...

Since 2007, the LoanSafe forums have helped millions of homeowners over the last 13 years either save their homes with a loan modification, obtain a short sale, forbearance, or walk away legally from their underwater mortgages. I was in the modification process with Wells Fargo. We had 5 meetings in court mediation to try and finish my modification. I submitted all information they wanted with my lawyer. They sold my mortgage (note) whatever to an investment company that does not modify a week payday loan same day before my last mediation. They want me to get a new mortgage (yeah right) or get out. This seems like bad faith tactics on WF and I would think (depends on the judge) the court would frown upon what WF just pulled and possibly rule in your favor. It really depends on how much you can spend on attorneys to file suit against them. To do this in the middle of negotiations is pretty shady to me. When they came to the table to mediate, they were supposed to be operating in good faith. Its obvious when you produced you financials and could prove you could qualify, they pulled the rug out from underneath you.

Other than that I was told the modification looked fine. NONE He said WF was so busy I should start the mod process over and resubmit all paper work. One week later I was notified that they sold the not. Since then I have been getting the run around from the investor.

They tried selling the note already but to no success. We (my lawyer) requested mediation and some how got it into court. Does anyone know the specific agreements with TARP and what the banks are supposed to do? No one is holding the lenders accountable to follow requirements. If you dont have a fannie or freddie loan, you lose some of the big stick to make them play according to the rules. You can go to Making Home Affordable site, as well as google TARP to find out more but your loan was sold out from underneath you while in the middle of mediation.

Loans without a cosigner

Whether you can sue over it is a question for attorney.

This is a different issue but it may be addressed in the TARP guidelines somewhere. I really think you might have grounds to file suit against WF.

My question would be was the loan owned by WF in the first place, or were how to get a loan fast they just the servicer? I assume they owned it otherwise they wouldnt be the ones in mediation or been able to sell it off to another investor. I also would call the mediator directly and address what just occurred and what they think should happen. I think if I can find any info on the TARP outline or somewhere else then my attorney would be excited to go quickcash com after WF. The mediator said to me that mortgage companies are starting to sell some loans while there in mod. Also I just filed a complaint with the Federal Reserve Consumer Complaint regarding what WF did to me including manipulating my appraisal back in 2007 Too bad the mediator doesnt seem to care but nice that your attorney seems interested in going after WF. I suggest you file complaints with the OCC (Office of the Comptroller) whom have jurisdiction over national banks. If you were in negotiations with WF for a HAMP modification and led to believe this is what you were mediating, then TARP would also be a place to file a complaint and attach any court documents (ie: minute orders, mediator notes). It will take some research into finding some language but I imagine you might uncover something fruitful for your attorney. If I have a chance, Ill take a look at what I can find. It takes a couple months to get these agencies to respond but call them regularly to follow up on your complaints and make sure they are received. Id also cc Wells Fargo on your complaints and the new investor. Yes, OCC does respond (did in my case) but may take a month and was submitted thru my Senators office. They just responded to OCC that I was now in the trial... If you have mediation in Court you must be in a judicial foreclosure State.

Those of us in non judicial have no opportunity to go to Court. But if you are in a judicial foreclosure and depending on where some States have required mediation which is great although outcome uncertain. Does anyone have any information on Trustco Bank in NY. I applied for a modification on Jan 5th, 2010 with GMAC and I was told last week that I was denied for both the MHAP also an in-house modification. I also received a call from someone in Loss Mitigation telling me to work with them to sell my house... I told him I would not sell it and that I would reapply for a modification.
